The White House and Congress today reached a deal on the most comprehensive overhaul of the nation's intelligence surveillance laws in 30 years. It would provide potential retroactive immunity for telecommunications companies that previously cooperated with the Bush administration's warrantless wiretapping program and extend government surveillance powers.
After months of negotiations between President Bush's top advisers and congressional leaders, the deal was announced today and set to be approved on the House floor tomorrow. Senate passage of the reauthorization of the Foreign Intelligence Surveillance Act, which had been held up since last summer largely because of fights about the immunity provision, would likely come next week.
Some Democratic leaders have argued that the bill does not go far enough in protecting civil liberties. They were backed by groups such as the American Civil Liberties Union that have filed lawsuits against telecommunications companies for helping the government monitor phone calls and e-mails into and out of the United States without warrants after the Sept. 11, 2001 attacks.
A key element of the new plan would give U.S. district courts the chance to evaluate whether telecommunications companies deserve retroactive protection from lawsuits. A previous proposal offered by Republicans would have put the question to the secret FISA court that approves the warrants.

The spineless Democrats demonstrate their cowardice again. The Republicans again demonstrate that blind loyalty to the Commander In Chief and their party trumps the Constitution and Americans ever dwindling Civil Liberties,...again!
Most Constitutional Law Scholars believe the NSA warrant less spying program violated the Fourth Amendment of The Bill Of Rights concerning Unreasonable Search and Seizure. In no way, should any Bill have been passed giving retroactive immunity to the phone companies. They were accomplices to law breaking.
We needed to send a clear message to future Commanders in Chief that if you engage Corporations into becoming accomplices in law breaking, there will be a price to pay, for both the President, and the guilty Corporations. Sen. Dodd, Sen Feingold, Rep Wexler, and Rep. Kucinich seem to be of the very few in Washington who have the courage to take the correct stand for "We The People." The FISA courts were set up in 1978, necessary, due to the Nixon administration and it's abuse of Executive Branch Power.
Back during Watergate, the Republicans in the House and Senate understood the importance of loyalty to your Country, above loyalty to your political party. Even the Republicans were prepared to Impeach. Nixon resigned instead, to avoid himself the embarrassment. I'm not sure if these new Republicans of today will ever do the right thing. Supporting spying on innocent Americans, torture, suspension of Habeas Corpus, The Patriot Act, Guantanamo Bay......
The Republicans continue to put loyalty to their party above loyalty to their Country, by not holding the Bush administration and the Telecom giants accountable for their law breaking and Constitution shredding. Our elected officials take a sworn oath to Defend The Constitution. Yet they don't. Shame on all the elected Republicans who continue to defend this corrupt, criminal Bush administration. You should be held accountable too for being the enablers of the worst, most corrupt, criminal, Presidential administration ever.
As for the Democrats, Shame on You too and the elected Democrats who simply lack the courage to Defend The Constitution. You take a sworn oath to Defend The Constitution, yet you don't. Once again I'm amazed at the spineless Democrats becoming even MORE cowardly as the 08 Pres election approaches.
Last week enough Senate Dems sided with the Republicans, thus caving in once again by not demanding no retroactive immunity to the phone company giants. Even though they have two thirds of the American voters on their side. They chickened out again!
Just like how they chickened out with the continued Iraq War Funding vote just before the Washington holiday season break! It's time to stand up to Bu$hCo and all of the law breaking and Constitution shredding. The Democrats who continually side with Bu$hCo are what gives the Democratic party of today it's spineless image. Unfortunately, it's an image they've earned.
